The application of international social security agreements as social protection mechanisms in South America
Main Article Content
Abstract
The present work has as its object of study the international agreements within the scope of social security law, with an approach in the countries that make up South America, thus seeking to analyze the forms of application of these devices, in addition to the reflection of the guarantee of social protection for migrants. In recent years, this subject has received greater attention due to the large migratory flow in South America and Latin America. One of the main characteristics of these devices is precisely to protect migrant workers, making effective their right to access their social security benefits, and, likewise, their access to social security institutes. It turns out that many of these immigrants find themselves helpless due to the increasingly restrictive rules regarding the scope of application of international social security agreements, also harming the lack of transportation of social security contributions between countries, and these restrictions are fostered by the current policy, which is shown to be increasingly restrictive, undermining the application and full development of these rights.
