Abstract

The article analyzes the topic of the social security initial claim, as well as aspects related to the art and technique of its drafting. Using an analytical-bibliographical methodology, the litigants' responsibility and their duty to cooperate were discussed so that legal action in social security cases is judged within a reasonable time. The social security initial claim involves aspects related to the technique of its preparation, but also the art in its writing. In the art of writing the initial claim, topics related to the use of simplified (but not simplistic) language were addressed, as well as the need to write clearly, objectively and concisely. The proposal is not to abandon technical concepts, which are understood as necessary for communication in the judicial process. The social security initial claim requires discretion in citing doctrinal and jurisprudential aspects. Regarding the technique of writing the petition, specific aspects related to the qualification of the parties, the facts and legal foundations, as well as the request are addressed.
