The litigation of social security claims by special insureds effects on the public budget and on society

Abstract
This paper fundamentally seeks to assess the social and financial impacts of the growing phenomenon of judicialization of social security claims for special beneficiaries. It also aims to identify plausible measures to prevent conflicts that could be resolved administratively from being brought to the Judiciary. To this end, the objective is to demonstrate the significance of observing this phenomenon for political and judicial management. The analysis encompasses examining the rates of approval of social security benefits for special beneficiaries in both administrative and judicial realms, as well as understanding the factors that lead these beneficiaries to the judiciary. Consequently, the article highlights the negative effects of the mentioned phenomenon, both for prospective beneficiaries and for the public sector. Additionally, it proposes satisfactory measures to mitigate these effects.
