SOCIAL SECURITY AND IMUNIZATION AN APPROACH OF BRAZILIAN CONSTITUTIONAL AMENDMENT N° 103/19 ACOORDING TO THE THEORY OF ROBERTO ESPOSITO

Abstract
This paper aims to analyse the Social Security Reform promoted by Constitutional Amendment no 103/19, considering the concept of immunity formulated by the italian philosopher Roberto Esposito. Firstly, it exposes that Social Security is intrinsically related to the ideia of social solidarity, which indicates thtat the riscks that affect individuals must be faced by the coordinated action of the entire community. Afterwards, it points that the measures proposed by Constitutional Amendment 103/19 counters the canons of social solidarity and, then, analyses three especific points of Social Security Reform, being them (i) the set of a minimum age for obtaining special retirement, (ii) the reduction of the value of the reclusion aid to the amount of 1 (one) basic wage and (iii) the modification of the calculation method of disability retirement. Finally, it explains how the process of dismantling of the protection system provided by Social Security can be understood by the concept of “immunity” (immunitas), sketched by Roberto Esposito.
