Prescrição e decadência nos benefícios previdenciários dos Regimes Próprios de Previdência Social

Abstract

The prescription refers to the time limit for proposition the action while the decadence refers to the time limit for practice of the rights. Prescription and decadence end to pretense and rights, because time passes and the holder does not exercise them, to ensure social pacification and legal security. Thus the application and limits of the prescription and decadence in the concessions, in the acts of registration and in the reviews of the social security benefits of the RPPS is analyzed.
