Abstract
This is a scientific article which aims to conceptualize “Pejotization”, present its historical development and describe its current status in the Brazilian legal context. Based on the analysis of doctrine and jurisdiction of the higher courts, it seeks to identify and present criteria that allow the differentiation of the occurrence of the institute of legal pejotização and the appearance of fraudulent “Pejotization.
