Abstract

The article discusses the unconstitutionality of labor moral damages, included in the CLT in 2017 under the name of extra-patrimonial damages. Using the inductive research method, the research conceptualizes moral damage and explains the reason for the unconstitutionality of article 223-A of the CLT. Therefore, amidst the institutional conflict between decisions of the Federal Supreme Court and Labor Courts, the Supreme Court needed to comment on the tabulation of values ​​indicated as parameters in possible compensation in labor relations, however, with a decision that does not highlight the unconstitutionality, but allows values ​​above those indicated in the CLT.
