Abstract
The present work aims to identify the controversial issues surrounding the state of legal uncertainty regarding the employee's labor pension, called labor pension limbo, and assess the employer's corporate responsibility. As a technical procedure, bibliographical research on the topic was carried out through documentary research, involving reading books on legal doctrine, legislation, academic works within this theme, among others that were relevant and necessary for the development of the work in question. The study will make it possible to analyze the relationship between work and the granting of disability benefits, as well as constitutional determinations regarding worker protection and the principle of human dignity. It is concluded that limbo consists of a situation of uncertainty in which workers are unable to work, but do not receive social security benefits or wages from the employer. It was found that the best alternative for the employer is to keep the employee away and pay him wages while this condition of incapacity persists, with the employee or even the company having to appeal or file a new request for disability benefits with the INSS. It was found that this hypothesis meets the principle of human dignity, providing a source of income while in this undefined situation, being able to cover basic survival expenses.
